DMNFR Ozone Nonattainment Area – Reclassification to “Serious” for the 2008 8-hour Ozone NAAQS

The current, enforceable 8-hour Ozone National Ambient Air Quality Standard (NAAQS) is 75 parts per billion (ppb).  Under the 2008 Ozone Standard, the EPA reclassified the Denver Ozone Nonattainment area from “marginal” to “moderate” in the Spring of 2016.  The region was given a deadline of July 12, 2018 to attain with the 2008 Ozone Standard but was granted a one year “clean year” extension after petitioning EPA to exclude emission monitor data correlated to wildfires events which met the EPA definition of “exceptional”.  The Governor’s Office repealed the clean year extension request and the region is currently facing an impending reclassification to “serious” nonattainment.

The current major source threshold for VOC and NOx (ozone forming precursors) is 100 ton per year (TPY).  A serious reclassification will reduce the major source permitting threshold to 50 TPY.  This means that the facilities operating as a minor source (i.e. emissions between 50 TPY and 99 TPY) will now be required to obtain a Title V Permit.

About the speaker:

Ms. Sara Lubchenco is a Senior Air Quality Professional and Project Manager with Tetra Tech.  She has her Bachelors and Masters of Science Degrees in Environmental Engineering Specializing in Air Quality and holds a Professional Engineering license in Colorado.  Ms. Lubchenco has over 14 years of experience in various areas and industrial clients to include chemical manufacturing, oil and gas, manufacturing, and Department of Defense.  Ms. Lubchenco has extensive nonattainment new source review permitting, RACT analysis completion, PTE assembly, Title V application, and compliance order/notice of violation support.  Most notably, she supported numerous facilities affected by the 2016 ozone nonattainment reclassification in 2016 and worked closely with CDPHE and clients through the process.
